The Bill (Reg.No.1375-1), seeks to ‘improve the legal regulation of the status of The People´s Deputy of Ukraine and The President of Ukraine´.
The Bill provides amendments to Article 80 of The Constitution of Ukraine to read:
‘Prior to a guilty verdict passed by the Court, the People´s Deputies of Ukraine cannot be detained or arrested, unless consent thereto has been given by The Verkhovna Rada of Ukraine´.
The revised first part of Article 105 shall read: ‘The President of Ukraine enjoys the Right of immunity during his term of office. Prior to a guilty verdict passed by the Court, The President of Ukraine shall not be detained or arrested, unless consent thereto has been given by the Verkhovna Rada of Ukraine´.
The Sponsors of the Bill, People´s Deputies,V.F. Yanukovych , O.V. Lavrynovych et al, state in the Explanatory Note that The Constitution of Ukraine provides a different area of immunity for the People´s Deputies of Ukraine, The President of Ukraine and the Judges. This immunity aims to safeguard officials from unlawful intrusion into their activities.
The People´s Deputies believe that the adoption of the suggested amendments will enable the status of the People´s Deputies of Ukraine, The President of Ukraine and the Judges, to be precisely regulated, and will make it impossible to use such immunity for the purpose of an escape from liability for a violation of the Law.
